Brothers face murder charges

Santa Clara County prosecutors charged a Santa Clara teenager and his older brother with murder Wednesday, alleging they are Samoan gang members who shot and killed two San Jose men at a Milpitas nightclub.

Nuuelua Sofara, 19, and Fealofai Sofara, 16, of Santa Clara, waived their arraignments Wednesday in Santa Clara County Superior Court. Each was charged with two counts of homicide as well as killing their victims as part of a criminal gang -- identified as a subset of the Crips. The specific gang was not named in the charging documents. Fealofai Sofara was charged as an adult because of the seriousness of the crime, prosecutors said.

Milpitas police also issued an arrest warrant for a third suspect: Michael Eti, 22, of Santa Clara. They consider him armed and dangerous and ask anyone who locates him to immediately call any local police department.

``Two people are dead. This is adult cold-blooded behavior,'' said Chief Assistant District Attorney Karyn Sinunu when asked why the 16-year-old was charged as an adult. She added that the suspects had passed out weapons ahead of time at a nearby park and that Fealofai Sofara's sister had begged him to put the gun down just before he allegedly fired the fatal shots into one of the victims.

The brothers are scheduled to enter pleas Wednesday.

They allegedly shot and killed Trevor De Voe, 24, and Irwin Dillon, 20, shortly before midnight Saturday outside of a Milpitas club.

It was a bloody end to a fist fight in which gang members allegedly attacked a small group of men -- perhaps mistaking them for a rival Tongan gang from Redwood City, according to court records.

After his arrest, Fealofai Sofara told a Milpitas detective, according to court documents, that there was ``concern between he and fellow Samoan friends'' that a Tongan gang who had previously allegedly ``shot up'' a San Jose neighborhood would be at a party at the Pacific Palms restaurant and bar near the Great Mall. About 30 people passed around guns at a park before the party ``to protect themselves against the Tongans,'' Fealofai Sofara told the detective.

A friend of the two told police that De Voe was beaten until he was unconscious, after which Nuuelua Sofara punched and kicked him.

Another witness heard the brothers' sister call out to Fealofai Sofara with his nickname just before the shooting: ``Fai, put the gun down. Fai, put the gun down.'' Then witnesses heard a series of shots and De Voe lay between two parked cars with mortal wounds to his chest. Fealofai Sofara denied to the detective that he shot anyone, court records said.

Then Eti shot Dillon in the head, a witness said.

As the large crowd in the club's parking lot scattered in chaos, a witness heard one of the suspects say to let them lay there to die, using a racial epithet.

The homicides were the first in Milpitas since 2003.
