Lovelyti2002 / Lovelyti wrongly claims false copyright after using our content

Unread post by alexalonso » May 22nd, 2016, 6:27 pm

There is this Youtube person named Lovelyti / Lovelyti2002 who took to twitter on May 18, 2016 to claim that Streetgangs made a false copyright claim against her Youtube channel after she used our original content of Snoop Dogg speaking at San Quentin Prison.

She went to Twitter and actually tweeted several inaccurate & slanderous tweets.

1. We did NOT issue any take down notice, like she falsely claimed on twitter, only a copyright violation which means that she can still keep the video up, but she just cannot MONETIZE the video, or make money off it, because it was not all her content. This tweet is a lie.

2. She actually sent an email to us on May 13, 2016, basically admitting to the violation (see below) and we responded to her on May 18, (see below) FIVE days later, not two weeks. Another lie.

3. We never tried to take her channel down period. ANOTHER LIE by Lovelyti. This women is delusional. The email she received from YOUTUBE was a copyright violation for one video. Additionally it did not require her to ever delete the video. It just meant that she could not monetize that ONE video or make money off it. Youtube does not allow you to make money off your video it there is content that is owned by someone else.

4. She made a slanderous and libelous comment by calling our action "shady practices" which is another lie. She already acknowledged her violation in the email on May 13 (see below), but she decided to go on her Twitter rant after our May 18 response to her refusing to remove the copyright violation. Additionally, that was 5 days later, not two weeks. Can we count days?

5. She claims that streetgangs has envy for her. There is no envy for her at all. We know nothing about her, never heard of her before, never used her video, never stole her content. She is the one using our content in one of her videos but she claims streetgangs has envy for her. Ridiculous.

6. She is threatening to do a video about streetgangs on her Youtube channel. If it goes like her Tweets, its most likely going to be filled with lies, slanderous and libelous comments and statements. We welcome her to continue Tweeting and we welcome her to do a video if she so desires. We can't wait for that.

7. She also turned this into a racial issue which is nothing but stupidity. This is a copyright claim where she was trying to make money off her video which included our content. Its very simple.

LAstly we are not going to retract a copyright claim we make against a Youtube user because it makes us look like we either made a mistake or changed our mind. When you file a copyright claim, its a serious position and you must be accurate or YOUTUBE will come down YOU if you make false claims. Reversing a claim is counter intuitive to the entire process. If she would have asked us to use our video and then give credit, we would have let her use our content like we let others in the past. But she NEVER reached out to us until we filed the claim, and she also cropped out our LOGO from the video, which we believe questions her business ethics. In her email she claimed that she didn't know that streetgangs was an established brand but she had the awareness to crop out our logo in her video edit. Not cool.

See all her tweets below, our response to her on May 18, 2016, and her email on May 13, 2016.

We responded to her on May 18, which was 5 days after, where we basically stated we will not retract any copyright claim. Then her rants on Twitter began.

This is her email dated May 13, 2016 which she basically admits to the copyright violation and apologizes for it. It's not until our May 18 response where we stated that we will NOT retract the claim, she decided to go on her Twitter rant. We normally block people's email address but she has her email posted publicly on her Twitter & Youtube channel.

LIAR, she posted this tweet right after we responded to her on Twitter (see first pic), that we will not retract the copyright claim. And here again, she says we made a false claim, which is another example of slander & defamation, which is legally actionable.

You moved foward after we responded to her. We refused to retract the copyright claim and that's when these Tweets started. We actually did respond to her (see above).

How is this a race thing? Is this the most ridiculous tweet of them all. Race? really? This is a person that cannot take responsibility for her own copyright violation. White people make copyright claims all day long on youtube for their music, movies, videos, all day long. This is an ignorant statement.

SHE IS a LIAR, WE NEVER took down her video. She deleted it. Her email is proof of that. Removal was her choice. Again she is a liar, and this tweet is actually is defamation. It's also slanderous and the longer she keeps that tweet up, the more damaging it becomes.

No jealousy at all. We don't even know anything about this woman to be jealous about. But our copyright claim was valid, and if it wasn't, she would have appealed it. She NEVER clicked that APPEAL button because she was 100 percent guilty.

False claims. She is a liar again. She already apologized in an email on 5/13 (see above). Again she is a straight up LIAR.

051816-twitter-007.jpg
We have nothing to be envious about her and her channel. This is about copyright violations which is not her first time violating someone's copyright.

051816-twitter-008.jpg
We challenge her to make a video about us at streetgangs. if she does that, then we will respond in kind. She stole our content, cropped out our logo, already apologized in an email on 5/13, then went on her Twitter rant on 5/18 after we responded to her.

051816-twitter-009.jpg
Again 5 days, and she is so dramatic. We never wanted to take her channel down, nor the video. We just didn't want her monetizing a video with our content in it. Also she cropped out our logo from the video too which we thought was really shady.

051816-twitter-011.jpg
May 13 to May 18 is not two weeks. More like 5 days. We made the copy right claim on May 12, she emailed us May 13 (see above) and we responded to her on Twitter on May 18. She cannot count, but that's 5 days.
051816-twitter-011.jpg (77.15 KiB) Viewed 8338 times
051816-twitter-012.jpg
Once she sent the email for us to retract the copy right claim, and we knew we were not, there was really nothing else to address. The ball was in her court to either keep the video on her channel or to delete it. She decided to delete the video.

051816-twitter-013.jpg
No one is hating on her. You just cannot simply steal someone else's content and then monetize it. Additionally we never said she needed to delete it. She could have kept it playing, but SHE chose to delete it.

UPDATE: apparently her false Tweets about streetgangs were not deleted.

As of May 24, 2016, Lovelyti deleted all her tweets from her 14 Tweet rant against Streetgangs. She never issued an apology or a statement for her slanderous or defaming tweets or that she was flat out wrong, mislead her followers, and tried to start a conflict when she was 100 percent guilty. The nerve of some people. If she issues an apology, I will delete this string on this forum, but if you are reading this, that means she NEVER apologized.

This woman rants and rants and rants on her Twitter page and she is ranting about BS, as if she is being mistreated or hated on in a way that is unusual. She needs to understand that if she does videos with misinformation, quotes from the police, doesn't do research, believes false narratives, people are gonna HATE.

She did the most ridiculous video about the shooting that Rapper Troy Ave was involved in and her desire to want to jump on the story and post a video quickly to her channel, caused her to just run with the BS story that the NY police fed the media. The NYPD is good for this too. They put out some BS story, let all the scavengers eat it up and post it, retweet it and do videos about it, then put another story out and all of a sudden, the story is evolving. When the police release only like 10 seconds of a video that is obviously longer: BEWARE! That is bait for the idiots.

Someone smart would say, "why is the NYPD showing a few seconds of this shooting? Is there more to the story? Was he returning fire? Was he shot at? Who was he shooting at and who was actually shot. Who shot the decedent?

And all this does is cause the defendant to have a more difficult time getting a fair trial because all this BS is floating around the internet and juries always go online to do their own research even though the judges instruct them not to. We should all HATE on this irresponsible and ignorant commentary.

She uses other people's videos in her videos, because she can carry a video on her own. She was hit with a copy right violation by the IOC, because the Olympics have been really strict about their videos on Youtube. NBC has been just as strict, but she thinks she is being singled out because of race as because she is "spitting knowledge" .

So when she cannot use a video, she will steal it, then upload it to her website, and point her followers to the stolen video on her website. She has no shame in stealing content, and she does not respect copyright.

I left a comment on her page, that was very respectful explaining her copyright violations, but she responding irrationally to the comment, then deleted it. She actually deleted all the comments that responded to our comment, and she basically blocked the comment. You can read it below. I know there is no such word as "disengenuine" but she actually used this word in her video and we thought it was appropriate to use.

Youtube has some basic rules that many Youtubers are complaining about but it's not that difficult to follow. Youtube is trying to create a family friendly environment for their advertisers, so these rules are only applied to content that people are MONETIZING and trying to make money off of.

<p>
If you are doing Youtube primarily to make money, that's will be difficulty because advertisers dont want to advertise on video like Philando being shot by the police on live video. But people like this woman above does not understand this. The only way you can monetize content on youtube and not worry about it getting flagged is to do the following:

1). post only YOUR content. Do not add clips of other videos or of content that is not yours. Respect copyright and if you want to monetize it dont rely on fair-use to protect you in all cases.

2. Dont curse. Why? This woman above is constantly cursing in her videos and most of the time the profanity is not even necessary. Advertisers do not want to advertise on a video when you are spewing profanities. Treat this as a business ans clean up that mouth.

3. Don't show any violent content, like Eric Garner getting choked out or Philando Castille breathing his last breath while bleeding profusely from the chest. YOu cannot monetize that. Youtube will allow you to keep it, but dont expect to make any money off it.

4. Dont scream racism unless it is really racism, and there are dozens of white youtubers that are going through the same thing, plus gamers, liberal content and conservative content. it is ABUNDANTLY clear that this has nothing to do with black voices or race. This has nothing to do with race, but it has to do with advertising. TIDE is going to receive backlash if their pre-roll is on a video where the police just shot someone. Now TIDE looks like their are capitalizing off of death and they will be criticized for it, so advertisers will stay away from that. If you want to talk about police brutality do so in a way that stays away from the graphic footage.

5. This has nothing to do with politics. If you understand the advertising industry this is obvious. If you are left or right leaning this has nothing to do with your political position, but it has to do with how "advertiser friendly" your video is. And again, you are not having your video taken down, just not monetized. Watch the Young Turks below explain this.

6. This is not a censorship issue, because you are free to post it on youtube or anywhere else. Not being able to monetize the video is not a censorship issue at all. Youtube is not deleting the video or saying you cannot post it to your account, but they are saying that you cannot advertise on the video and make money.
